VOUCHER AND TICKET SALES TERMS AND CONDITIONS

1. General Provisions

1.1. These Sales Terms and Conditions govern the purchase of electronic gift vouchers and electronic event tickets on the website thecartel.retiva.io (the "Store"), operated by:

(hereinafter: "The Cartel" or "Seller")

1.2. Technical operation of the Store is provided by Retiva.io (MS Quality Maria Szruba, NIP: 6462759343, REGON: 243418180, ul. gen. Pułaskiego 38 lok. 11, 40-276 Katowice, Poland) — a voucher and ticket sales platform. Retiva.io acts solely as a technology provider and is not a party to the sales contract concluded between the Buyer and The Cartel.

1.3. Purchasing a voucher or ticket constitutes acceptance of these Sales Terms. Rules for using the product are set out in separate documents: for vouchers — the Voucher Redemption Terms; for tickets — the Ticket Terms (/legal/terms-ticket), which govern, among other things, refunds in the event of cancellation, postponement, or behind-closed-doors staging of the event.

1.4. Buyers must be natural persons with full legal capacity (or acting through a legal guardian), legal entities, or unincorporated organisational units.

2. Offer and Prices

2.1. The Store offers monetary vouchers and event tickets in the variants presented on the Store website. The current offer — including available denominations or categories, purchase prices, and any promotions — is displayed at the time of ordering and may change. Information shown at the time of purchase is binding for that transaction.

2.2. The purchase price of a voucher may be lower than its face value when The Cartel runs a promotional offer. Details of any promotion are shown on the Store website at the time of purchase. For tickets, the price shown at purchase is the sale price of that ticket category.

2.3. All prices are quoted in Polish Zloty (PLN) and are gross prices (inclusive of VAT at the applicable rate, where applicable).

2.4. The Cartel reserves the right to change the voucher and ticket offer and prices at any time. Changes do not affect already concluded transactions.

3. Contract Formation and Payment

3.1. An order is placed when the Buyer completes the form on the Store website and clicks "Proceed to Payment" (or equivalent).

3.2. The sales contract is concluded upon full payment for the voucher or ticket being confirmed by the payment operator.

3.3. Payments are processed by a third-party payment operator. The Cartel does not store payment card data or other sensitive financial information.

3.4. If payment fails, the order is cancelled and the Buyer may place a new order.

3.5. A service fee may be added to the voucher or ticket price, clearly indicated before payment. The service fee is remuneration for a sales-intermediation service already performed and is non-refundable — including where the product price is refunded (e.g. due to event cancellation or postponement). In such cases, only the voucher or ticket price is refunded.

4. Delivery of Voucher or Ticket

4.1. The voucher and the ticket are delivered in the same way — exclusively in electronic form. After payment is confirmed, the Buyer receives, at the e-mail address provided, a link to the order confirmation page, where they can display the QR code, download a PDF, and add the product to a digital wallet (Google Wallet / Apple Wallet).

4.2. The Buyer is responsible for providing a correct e-mail address. The Cartel is not liable for non-delivery caused by an incorrect address.

4.3. If the product is not received shortly after payment, the Buyer should: (a) check the spam/promotions folder, (b) contact The Cartel at thecartelktw@gmail.com.

5. Right of Withdrawal

5.1. Pursuant to Art. 38(12) of the Polish Consumer Rights Act of 30 May 2014, the right to withdraw from a distance contract does not apply to contracts for the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's express consent.

5.2. Given the electronic and immediate nature of voucher or ticket delivery, the right of withdrawal does not apply once the product has been delivered, provided the Buyer expressly requested immediate delivery of the digital content.

5.3. Vouchers: if the voucher has not been used, The Cartel may — solely at its discretion and as an exception — issue a refund; refund requests must be sent to thecartelktw@gmail.com within 14 days of purchase, including the voucher number/code and reason. Tickets: refunds in connection with the cancellation, postponement, or behind-closed-doors staging of the event are governed by the Ticket Terms (/legal/terms-ticket).

6. Transaction Complaints

6.1. Complaints relating to the purchase process must be submitted in writing — including by e-mail — to: thecartelktw@gmail.com.

6.2. A complaint should include: the Buyer's full name, the e-mail address used for the purchase, the voucher or ticket number/code (if available), and a description of the problem.

6.3. The Cartel will respond to complaints within 14 calendar days of receipt.

7. Personal Data Protection

7.1. The controller of the Buyer's personal data is The Cartel (details in Section 1).

7.2. Personal data (full name, e-mail address, phone number) are processed for the purpose of:

performing the voucher or ticket sales contract (Art. 6(1)(b) GDPR);

fulfilling legal obligations, including tax obligations (Art. 6(1)(c) GDPR);

direct marketing — only with the Buyer's separate consent (Art. 6(1)(a) GDPR).

7.3. Data is shared with processors: Retiva.io (MS Quality Maria Szruba, NIP: 6462759343, ul. gen. Pułaskiego 38 lok. 11, 40-276 Katowice, Poland — platform operator) and the payment operator — solely to the extent necessary to complete the transaction.

7.4. The Buyer has the right to access, rectify, erase, restrict processing of, and port their data, as well as to object and to lodge a complaint with the President of the Polish Personal Data Protection Office (UODO, ul. Stawki 2, 00-193 Warsaw).

7.5. Full details on data processing are set out in the Privacy Policy available on the Store website.

8. Final Provisions

8.1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.

8.2. Consumers may use out-of-court dispute resolution via the EU ODR platform: https://ec.europa.eu/consumers/odr or the Polish Trade Inspection (Inspekcja Handlowa).

8.3. The Cartel reserves the right to amend these Terms. Amendments take effect upon publication of the updated version on the Store website.

8.4. These Terms are effective as of 6 May 2026.
