Ticket Terms

1. General Provisions
1.1. These Ticket Terms set out the rules for using an electronic admission ticket (the "Ticket") to an event organised by The Cartel, ul. Św. Filipa 23/3, 31-150 Kraków, Polska, e-mail: thecartelktw@gmail.com (the "Organiser").
1.2. Purchase rules are set out in a separate document — the Sales Terms. This document governs only the use of the Ticket after purchase.
1.3. Technical operation of the sale is provided by Retiva.io (MS Quality Maria Szruba, NIP: 6462759343, ul. gen. Pułaskiego 38 lok. 11, 40-276 Katowice, Poland). Retiva.io is solely a technology provider and is neither the event organiser nor a party to the relationship arising from the Ticket.
1.4. Holding and using the Ticket constitutes acceptance of these Terms and of the venue rules.
2. What the Ticket Is
2.1. The Ticket is a personal or bearer (as described in the offer) electronic document granting a single admission to the specified event.
2.2. The Ticket is made available on the order confirmation page (link sent by e-mail): display of the QR code, download of a PDF, and adding it to a digital wallet (Google Wallet / Apple Wallet).
2.3. The QR code is the sole basis for verifying the right of admission. The Ticket is deemed used upon the first successful scan of the QR code at entry.
3. Validity
3.1. The Ticket is valid only for the specific event stated on it, on the date and at the place specified.
3.2. The Ticket grants a single admission. After leaving the venue, re-entry on the same Ticket may not be possible unless the Organiser expressly permits it.
3.3. A Ticket that is invalid or damaged so that the QR code cannot be read does not grant admission.
4. Admission Rules
4.1. The venue gates open before the event begins; the opening time is set by the Organiser.
4.2. The QR code is scanned on entry. Any subsequent scan of the same Ticket is rejected as already used.
4.3. The Organiser may make admission conditional on presenting an identity document (personal tickets), remaining sober, and undergoing security checks in accordance with the venue rules and mass-event safety regulations.
4.4. The Organiser reserves the right to refuse admission to, or remove from the venue, persons breaching the venue rules, safety rules, or public order — with no right to a refund of the Ticket price.
5. Transfer of the Ticket and Resale Ban
5.1. The Ticket may be passed to another person free of charge or at face value, unless the Organiser provides otherwise for personal tickets.
5.2. Commercial resale of the Ticket above face value, and its use for marketing, promotional, or competition purposes without the Organiser's written consent, are prohibited.
5.3. A Ticket from an illegal source or resold in breach of clause 5.2 may be voided with no right to a refund.
6. Lost or Stolen Ticket
6.1. If the Ticket is lost, the Buyer may ask the Organiser to re-send it to the e-mail address used at purchase.
6.2. For security reasons, the Organiser may refuse to re-issue the Ticket if the original QR code has already been used.
7. Cancellation, Postponement, or Behind-Closed-Doors Staging
7.1. If the event is cancelled, the Buyer is entitled to a refund of the price paid for the Ticket.
7.2. If the event is postponed, the Ticket remains valid for the new date. If the new date does not suit the Buyer, they may request a refund within 30 days of the new date being announced.
7.3. If the event is held behind closed doors, the Buyer is entitled to a refund of the Ticket price.
7.4. Refunds are made via the original payment method within 14 days of confirming the basis for the refund. Only the Ticket price is refunded; any service fee is non-refundable (in accordance with § 3 of the Sales Terms).
7.5. The Organiser is not liable for additional costs incurred by the Buyer (travel, accommodation, etc.).
8. Liability and Safety
8.1. The attendee is present at the venue on the terms of the venue rules and mass-event safety regulations and is obliged to comply with them.
8.2. The Organiser is not liable for damage caused by the attendee's fault or as a result of breaching the venue rules.
9. Complaints
9.1. Complaints regarding the Ticket or the conduct of the event should be sent to: thecartelktw@gmail.com.
9.2. A complaint should include the Buyer's details, the Ticket number/code, and a description of the matter. The Organiser handles complaints within 14 calendar days.
10. Personal Data
10.1. The controller of personal data is the Organiser. Data is processed to deliver the rights arising from the Ticket and to meet legal obligations (Art. 6(1)(b) and (c) GDPR).
10.2. Full details on data processing are set out in the Privacy Policy available on the Store website.
11. Final Provisions
11.1. Matters not covered herein are governed by Polish law, in particular the Civil Code and the Mass Events Safety Act.
11.2. The Organiser reserves the right to amend these Terms; amendments take effect upon publication and do not affect rights already acquired under Tickets already purchased.
11.3. These Terms are effective as of 6 May 2026.
